Important Changes to Buy America Requirements for

Federally Funded Contracts (April 2023)

The Infrastructure Investment and Jobs Act (the “IIJA” more commonly known as the “Infrastructure Bill”) made significant changes to Buy America requirements via the Build America, Buy America Act (“BABA”).  See Pub. L. No. 117-58, §§ 70901-27.  Construction materials covered by BABA, which must now be produced in the United States, include non-ferrous metals, plastic and polymer-based products (including PVC, composite building materials, and polymers used in fiber optic cables), glass (including optic glass), lumber, and drywall. The list of covered construction materials may be expanded in the forthcoming implementing regulations.

Prospective bidders and proposers are encouraged to familiarize themselves with new and developing BABA guidance issued by the federal government, including the Notice of Proposed Guidance issued by the Office of Management and Budget (OMB) and published in the Federal Register on February 9, 2023, which may be viewed at:  https://www.federalregister.gov/documents/2023/02/09/2023-02617/guidance-for-grants-and-agreements
